Lees vs. Morgan is action
brought by Clifford H. A. Lees of Port Dover, against L. H. Morgan of The
Port Dover Maple Leaf.
The alleged cause of action
arises out of the conditions of the will of Andrew Thompson, who died in
Port Dover in 1882.
It is claimed that Morgan, who
acted as trustee of the estate after the death of David Thompson, the
original executor of the will, has failed to turn certain lots along the
waterfront over to Lees as the only remaining heir of the testator.
The defendant claims that he has
fulfilled his trust and has in his possession a release of same from
plaintiff and his mother, through whom he claims to inherit the property
in question.
Immediately on the opening of
the court W. T. McMullen of Woodstock addressed the court. He stated
that he represented the Penman Co. That they were and had been for years
in occupation of some of the lands involved, and his clients wished to
be made parties to the suit, and the trial was postponed to give him an
opportunity to prepare his case.
